Selling a Property

If you are selling a property, the first step is to instruct a solicitor to handle the transaction. Once an offer has been accepted, we will carry our due diligence checks which will continue throughout the transaction, prepare the contract pack, and send this to the buyer’s solicitor.

You will need to complete the Property Information Form (providing relevant information about the Property) and the Fittings & Contents form (setting out what items are included in the sale) for us to send as part of the contract pack. The buyer’s solicitor will then review the contract pack, carry out property searches and raise enquiries.

We will work with you to respond to the enquires raised. Once all queries are resolved, the mortgage offer received by the buyer (if applicable) and the chain is ready and a completion date is agreed, we will then be in a position to exchange contracts on your behalf. At this stage, the sale becomes legally binding, and a completion date is set. On the day of completion, funds are transferred, the keys to the property are handed over, and the sale is finalised.

Buying a Property

If you are purchasing a property, the process starts with instructing a solicitor once your offer has been accepted. We will carry our due diligence checks which will continue throughout the transaction. The seller’s solicitors will prepare the contract pack. Once we have received the contract pack we will review the draft contract, conduct legal checks, and apply for the usual property searches, such as local authority, drainage, environmental, and, if necessary, coal mining reports. These searches help uncover issues that could affect your purchase.

If you are obtaining a mortgage, it is likely that we will also be required to act for your mortgage lender (unless the lender requires separate legal representation). We will review your mortgage offer and take steps to comply with any conditions imposed by the lender.

Once we are in receipt of the search results, satisfactory replies to all enquiries, and you are happy to proceed, we will arrange for you to sign the contract and pay the deposit. When the chain is ready to proceed and a completion date agreed, contracts will be exchanged, making the purchase legally binding. Completion typically happens a few days or weeks later, depending on the agreement with the seller. On the day of completion, funds are transferred, and you officially receive the keys to your new home.

If you wish to purchase a property with a mortgage, most lenders will require you to instruct a Solicitor or Conveyancer to act on your behalf. Your Solicitor or Conveyancer may also be required to act on behalf of the lender in relation to the transaction unless there is a conflict of interest or the lender wishes to instruct its own Solicitor or Conveyancer.

It may not always be necessary to instruct a Solicitor or Conveyancer to act on your behalf in respect of your remortgage transaction. It will often depend upon the nature of the transaction and the specific requirements of your lender.

In circumstances where you wish to extend your current mortgage or change to a new product with your current lender, the assistance of a Solicitor or Conveyancer may not be needed.

If you are looking to remortgage your property with a new lender, it is likely that the assistance of a Solicitor or Conveyancer will be required. However, some lenders offer a free legal package as part of the remortgage deal. In such instances the lender will appoint a Solicitor or Conveyance of its choice to undertake the legal work.

If you are looking to switch your mortgage to a new product with the same lender it may not be necessary to instruct a Solicitor or Conveyancer to act on your behalf.

If you wish to switch your mortgage to a new lender the assistance of a Solicitor or Conveyancer is usually required to undertake the legal work involved. However, some mortgage lenders offer a free legal package as part of the remortgage deal. In these circumstances the lender appoints a Solicitor or Conveyancer of its choice to undertake the legal work.
