Legal Aid

Legal Aid may be available in Magistrates’ Court and Crown Court cases, subject to two eligibility criteria; an Interest of Justice test and a Financial Means test.

Persons under 16 years or under 18 years in full-time education or in receipt of a “Passporting Benefit”, automatically qualify for Legal Aid based on Means.  The Legal Aid Agency (LAA) will then assess whether it is also in the Interest of Justice for Legal Aid to be granted.

Persons 18 years and over with a source of income, other than a “Passporting Benefit”, the LAA will assess “adjusted income”.   The Magistrates’ Court and Crown Court have different Means Thresholds.
